KSL’s Representation to Symposium on Foreign Related Rule of Law in the Field of Civil Aviation

During the Visit of faculty member Assoc. Prof. Yugichha Sangroula and Mr. Kshitiz Parajuli to the Civil Aviation university of China, Tianjin, China on 15th September 2024 as representation from Nepal, Kathmandu School of Law was invited to attend Symposium on Foreign Related Rule of Law in the Field of Civil Aviation for the celebration of the 80th Anniversary of the Chicago Convention. Where representatives from International Civil Aviation Organization (ICAO), International Air Transport Association (IATA), Civil Aviation Authorities of China (CAAC), The International Cooperation and Service Center Civil Aviation Administration of China (ICSCC) presented presentations aiding the Civil Aviation Industry its Law and Education. On the behalf the Kathmandu School of Law Assoc. Prof. Yugichha Sangroula mentioned the Participation and Contribution of Nepal in International Civil Aviation and how Nepal is progressing the industry and efforts of Kathmandu School of Law to introduce the expertise and education of the Civil Aviation Law. Key Notes of her Speech included the Nepal’s shift in participation of Montreal Convention from Warsaw Convention for effective regulatory framework that will aid in safety regulation and Compensation of the victim, She also highlights how Nepal can provide a transit connectivity in Civil Aviation for South East Asia with 3 airports in operation. She also mentioned how Nepal has taken steps of Complimentary Approach that helps in expanding and growing Tourism and Civil Aviation both on parallel manner in Nepal, New legislative order that governs Service, Safety and Security in Nepal was also quoted by Assoc. Prof. Sangroula. For the encouragement of Law Students she also mentioned how serious dialogues have been shared for introducing specialized courses in Civil Aviation at University Level on the long term objective which are the Academic Initiatives for Civil Aviation study in Nepal.

To specify the Seminar it consisted of two sessions (Opening and Closing ) and Keynote Speech which comprised of many International and National Representatives from the organizations like CAAC, ICAO like and 4 panels which presented crucial presentations on the Development of Civil Aviation and recognition of ICAO. With speech of General Secretary of ICAO, Deputy Administrator of CAAC, Former Director of Legal Affairs and External Relations Bureau of ICAO, former Chairperson of Legal Committee of ICAO and other distinguished experts of CIVIL Aviation. In first Panel presentations on Chicago Convention and formation of the order of International Civil Aviation were presented. In this session the Symposium look back towards the history of Chicago Convention which is the first Convention on the field on Civil Aviation where Countries participated. This panel consisted also consisted of various subject matter like the Role of ICAO Regulatory Framework in Aviation Safety, New Developments of the Montreal Protocol 2014.

Second Panel highlighted China’s Implementation of Beijing Convention and Beijing Protocol which insights on the New Crime trends and how Beijing Convention bring advancement to criminalize any Civil Aircraft which is designed to commit acts of terror and crime. The panel also emphasized on the attempts to reduce Organized Crimes and Terrorism and also critiques that aids to solve the Conflict of Administrative Right and Expand management of Administrative Scope. Presentations also highlighted Beijing Convention and its Relation of Airport Security, Margin of International and National Security Check. 
 
Third Panel discussed about New Developments in Regulations of International Civil Aviation where papers were presented on the Development of the Reform of Dispute Settlement mechanism of ICAO. Trends of Cross Border protocol and Role and Contribution of the Legal Committee of ICAO. The session enlighten the Risk Management of Civil Aviation Aircraft’s Flight over Areas of Armed Conflict as the developments in regulation of Civil Aviation. As way forward presentation was also made on Reflections on the Improvement of Montreal Convention 1999. 
 
Fourth panel was dedicated for New Challenges facing the International Aviation Rules where presentations were reflective upon balancing economy of the Civil Aviation and Environment Concerns and prospectus and Implication of Sustainable Aviation Fuel (SAF), Data Protection (Civil Aviation Law and Data Compliance) presentation were also made regarding the legal issues relating the operation of aircraft with the external and internal space. Highlights were also made on the Cross- Border E-Commence and International Logistics by Air which are the developing challenges on Civil Aviation Law and Regulations.
