Assistant Professor Swechhya Sangroula was part of amici curiae that submitted Brief of International and Comparative Legal Scholars as Amici Curiae in Support of Respondents in Dobbs v. Jackson Women’s Health Organization, et. al . in the Supreme Court of the United States, No. 19-1392, September 2021.
The brief provides a ‘rigorous comparative law analyses’ of foreign abortion laws with an aim to assist the Supreme Court of the United States in deciding the case. Among others, the brief outlines that comparative law analysis has utility and importance to the Supreme Court in interpreting the fundamental rights protected by the US Constitution.
An amicus curiae is someone who is not a party to a case who assists a court by offering information, expertise, or insight that has a bearing on the issues in the case. The decision on whether to consider an amicus brief lies within the discretion of the court.
